Terms of Service for BeCraved AI

1. Introduction

"We," "Our," or "Us" refer to BeCraved AI, a trade name of Pixelheads B.V., registered in The Netherlands with the Chamber of Commerce under number 69959447, located at De Nieuwe Erven 3, 5431 NV Cuijk. These Terms of Service ("Terms") govern your use of BeCraved AI (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately.

You must be at least 18 years old to use the Service.

2. Changes to the Terms

We may update these Terms from time to time. When we do, we will notify you via email or post the updated Terms on our website. We will email you about important changes at least 30 days before they take effect. If you do not agree with a change, you can cancel your subscription or delete your account before it takes effect. Continued use of the Service after that means you accept the revised Terms.

3. Eligibility and Account Registration

To use BeCraved AI, you must register an account. By creating an account, you confirm that you are providing accurate, current, and complete information. You are responsible for safeguarding your account credentials and for all activities under your account.

3.1 Age Restriction

You must be at least 18 years old to use the Service. By registering, you confirm that you meet this age requirement. Where the law of your country or state requires it, we may ask you to pass an age check by an independent age-verification provider before you can access adult content. The Service is not available in every country.

3.2 Account Security

You are responsible for keeping your account secure. If you suspect unauthorized use of your account, contact us immediately at [email protected].

4. Subscriptions, Payments, and Credits

The Service offers subscription-based access to certain features, as well as in-app currency ("Credits"). By subscribing or purchasing Credits, you agree to pay all applicable fees. Prices are shown before you pay. Card payments are processed by Epoch and crypto payments by NOWPayments or CoinGate.

4.1 Subscription Plans

We offer different subscription plans. A subscription paid by card automatically renews for the same period and price unless you cancel it before the renewal date. You can cancel online at any time in your account settings; you keep access until the end of the period you paid for. We email you before a card renewal, and we tell you about a price change in advance so you can cancel first. A subscription paid with crypto does not renew automatically.

4.2 Credits

Credits can be purchased and used within the Service. They have no real-world monetary value and cannot be transferred or exchanged for cash, and they are not refundable except as set out in sections 4.4 and 4.5.

4.3 Rewards

You can earn free rewards in the Service, such as Credits, bonus messages and free photos, for example through daily check-ins, weekly goals and conversations with our characters. Rewards are free extras: they have no monetary value and cannot be transferred or exchanged for cash. Unclaimed rewards from conversations expire 30 days after you earn them, and free photos expire 30 days after you receive them. Subscribers can collect up to 500 reward Credits per UTC calendar month, including Discord daily rewards and written feedback rewards. Platform reward Credits, including feedback but excluding Discord daily rewards, are also limited to 300 Credits in any rolling seven-day period. Free accounts can collect 150 reward Credits in total; written feedback does not consume that lifetime allowance. Discord daily rewards give 5 Credits per UTC day and count toward the applicable monthly or lifetime allowance. Purchased Credits, subscription Credits, refunds, and one-time signup and Discord welcome grants do not consume these reward allowances. Achievement rewards are paid in full or remain uncollected while a limit prevents payment; feedback rewards may be reduced to the available allowance. Characters you create yourself do not earn rewards. We may change, pause or end rewards, and may withhold or reverse rewards obtained through misuse, such as multiple accounts or automation.

4.4 Refunds

We evaluate refund requests on a case-by-case basis. If you experience any issues with your purchase, please contact our support team at [email protected] within 14 days of the transaction. We reserve the right to approve or deny any refund request in our sole discretion. This does not affect your statutory rights.

4.5 Right of Withdrawal

If you are a consumer in the European Union or the United Kingdom, you normally have 14 days to withdraw from an online purchase. When you buy Credits or a subscription, you ask us to start right away. For Credits, you agree that you lose your right of withdrawal once the Credits are added to your account. For a subscription, you can still withdraw within 14 days by contacting [email protected], and you pay only for the part of the period you have already used.

5. Use of the Service

You agree to use BeCraved AI only for lawful purposes and in accordance with these Terms. You are solely responsible for the content and activities you post or engage in while using the Service.

5.1 Prohibited Conduct

You agree not to:

• Use the Service for any illegal activities.
• Impersonate any person or entity, or falsely claim an affiliation.
• Post content that is abusive, defamatory, obscene, or otherwise inappropriate.
• Engage in spamming, phishing, or any form of exploitation of other users.
• Attempt to reverse-engineer or tamper with the Service.

We reserve the right to investigate and take legal action in response to any violation of these rules.

5.2 Artificial Intelligence Interactions

Users of BeCraved AI acknowledge and agree that:

• All interactions on the platform are with artificial intelligence characters and not real people
• AI characters are incapable of forming genuine emotional connections or relationships
• Any perceived emotional or personal connection with an AI character is artificial and should not be acted upon in the real world
• Users are solely responsible for their emotional and psychological well-being when using the Service
• BeCraved AI is not a substitute for professional mental health services or real-world relationships

Users agree to use the Service responsibly and to seek professional help if they experience any negative emotional or psychological effects from their use of the Service.

6. User-Generated Content

You retain ownership of the content you submit to BeCraved AI. However, by submitting content, you grant Pixelheads B.V. a worldwide, royalty-free, non-exclusive license to use, modify, and display your content as needed to provide the Service. This license ends when you delete the content or your account.

You agree not to submit content that infringes on the rights of others or violates any laws. We may remove or modify any content at our discretion.

We may process conversation content to provide the Service, maintain memory and personalization, investigate safety or support issues, improve product quality, and perform aggregate analytics such as topic trends and subscription churn analysis. Raw conversation review is restricted to authorized personnel and internal tooling with access logging.

7. Intellectual Property

All elements of BeCraved AI, including but not limited to the code, design, logos, AI-generated content, and interactive features, are owned by Pixelheads B.V. or licensed to us. You may not use our intellectual property without our express written permission.

8. Privacy

Your use of BeCraved AI is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

9. Service Availability and Modifications

We strive to keep BeCraved AI available and functioning at all times, but we do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any aspect of the Service at any time without liability.

10. Disclaimer of Warranties and Limitation of Liability

BeCraved AI is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of fitness for a particular purpose and non-infringement. You understand and agree that your use of BeCraved AI is at your own risk. We are not responsible for any emotional distress, psychological harm, or any other damages that may result from your interactions with our AI characters. Our AI characters are not real people and are not capable of forming genuine relationships. Any perceived emotional connection is artificial and should not be taken as real or acted upon in the real world. In no event shall Pixelheads B.V. be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of BeCraved AI, including but not limited to emotional distress, psychological harm, or actions taken based on interactions with our AI characters. Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid to us in the last twelve months.

11. Limitation of Liability

In no event shall Pixelheads B.V. be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of BeCraved AI. Our total liability to you for any claims arising under these Terms shall not exceed the amount you have paid to us in the last twelve months.

Nothing in these Terms limits or excludes our liability for intent or gross negligence, for death or personal injury, or any other liability that cannot be limited by law, and nothing in these Terms affects your rights under mandatory consumer law.

12. Moderation, Suspension and Termination

We use automated tools and human review to keep the Service safe and within these Terms. Automated tools may flag content for review, shape a single reply, or keep an account's content non-sexual until our team has reviewed it, but decisions about your account, such as a warning or a suspension, are made by a member of our team.

If you break these Terms, we may give you a warning. Repeated or serious violations, or reason to believe you are under 18, may lead us to suspend or terminate your account, in serious cases without a prior warning. When we take action against your account, we tell you the reason.

If your account is suspended, you can appeal from the page you see when you sign in. We review every appeal and reply by email. We reserve the right to suspend or terminate your account at any time if we determine that you have violated these Terms or pose a risk to the Service or its users. Upon termination, your right to use the Service will cease immediately.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of The Netherlands. Any disputes arising out of or in connection with these Terms shall be resolved by the competent courts of The Netherlands. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring a claim in the courts there.
